ДОГОВІР ПУБЛІЧНОЇ ОФЕРТИ

Даний Договір є публічним, відповідно до Цивільного кодексу України. Користуючись цим Сайтом, ви приймаєте, приєднуєтеся та погоджуєтеся із умовами цього договору.

Терміни та визначення
1. Гість - особа, яка користується Сайтом та/або здійснює бронювання відповідно до умов визначених у цьому Договорі і є стороною цього Договору.
2. Сайт - інтернет-ресурс, що розміщений за адресою https://yavdoma.com . Власник Сайту - ФОП Бондарчук Віталій Володимирович, витягу з ЄДР, № 2000680000000048838 від 16.12.2020 року.
3. Підтвердження бронювання (далі - Підтвердження) - електронно-цифровий документ, що містить інформацію про бронювання.
4. Постачальник послуг - особа, яка розмістила інформацію про об’єкт проживання та надає послуги розміщення у цьому об’єкті.
Загальні положення
1. Сайт є онлайн платформою де Постачальники послуг розміщують свої об’єкти проживання, а Гості їх шукають та бронюють.
2. ФОП Бондарчук В.В. не є стороною угоди при здійсненні бронювання. ФОП Бондарчук В.В. володіє Сайтом, та надає можливість Гостям, знайти та забронювати помешкання, яке було надано одним із Постачальників послуг.
3. Після бронювання, Сайт надішле Гостеві Підтвердження з детальною інформацією про бронювання. Таке ж Підтвердження буде надіслано Постачальнику.
4. Підтримка користувачів Сайту працює згідно умов викладених у відповідному розділі на цьому сайті.
Ціни та тарифи
1. Сайт не бере участі у ціноутворенні, створенні умов тарифів, оплаті послуг проживання. Сайт не відповідає за виконання або невиконання умов тарифу та умов оплат і не несе відповідальність за можливі збиткі, які були спричинені такими діями.
2. Після бронювання, на вимогу Постачальника, Гість має сплатити послуги Постачальника, у тому числі у разі потреби надати дані банківської карти, у т.ч. для гарантії бронювання. У разі повної або часткової несплати, невчасної оплати, Постачальник має право відмінити бронювання.
3. Очевидні помилки та опечатки, очевидна неринкова ціна на послуги проживання, не мають юридичної сили. Подібне бронювання може бути відмінено з поверненням Гостю оплачених коштів.
4. Сайт не збирає та не передає дані банківських карт і не приймає участі у фінансових транзакціях між Гостем та Постачальником. Відповідальність, щодо надання або не надання даних банківської карти, лежить на Гостеві.
5. Відміна бронювання може бути здійснена Гостем з урахуванням умов тарифу. Відміна бронювання Гостем можлива лише через власний кабінет, який Гість створив на Сайті. Також відміна бронювання може бути здійснена Постачальником у разі незаїзду гостя або відмови від виконання умов тарифу або відмови від повної або часткової оплати. Гість відповідальний за можливі збитки спричинені у результаті відміни.
6. Відміна бронювання через «Незаїзд» Гостя (no-show) здійснюється Постачальником відповідно до умов тарифу вказаного у бронюванні. Гість відповідальний за можливі збитки спричинені у результаті не заїзду.
7. Зміна бронювання передбачає зміну дат, і відповідну зміну вартості бронювання. Зміна бронювання можлива лише Гостем і лише через його кабінет на Сайті. Зміна бронювання можлива лише за наявності вільних кімнат у Постачальника. Зміна бронювання можлива лише за умови виконання тарифного плану. У разі невиконання умов тарифу при зміні бронювання, Постачальник має право відмінити таке бронювання. Гість відповідальний за можливі збитки спричинені у результаті зміни бронювання.
8. Стандартний тариф передбачає оплату в момент заїзду Гостя в помешкання Постачальника. При цьому Постачальник має переважне право вимоги попередньої оплати бронювання для гарантії цього бронювання. Невиконання умов оплати є підставою для відміни бронювання.
9. Безповоротний тариф передбачає оплату в момент бронювання. При цьому Постачальник має переважне право вимоги попередньої оплати бронювання для гарантії цього бронювання. Невиконання умов оплати є підставою для відміни бронювання.
Правила сайту та застереження
1. Інформація на Сайті про об’єкти проживання розміщена Постачальниками. Постачальник несе відповідальність за розміщену інформацію про свій об’єкт. Якщо ви знайшли інформацію, яка вам видається інформацією неприпустимого змісту, будь ласка повідомте нас за допомогою електронної пошти.
2. Для створення бронювання Гостеві необхідно створити власний аккаунт (власний кабінет) на Сайті. В аккаунті зберігається інформацію про всі бронювання Гостя. Змінити або відмінити бронювання Гість може лише через свій власний кабінет. Комунікація між Сайтом та Гостем проходить переважно за допомогою електроної пошти, згідно графіку роботи Служби Підтримки Сайту. При цьому, через завантаженість Служби Підтримки, Сайт не гарантує вчасне обслуговування. Гість відповідає за зберігання доступу до свого аккаунту, а також за правильність надання адреси електронної скриньки, та номеру телефону.
3. Сайт не несе відповідальності за будь-які збитки спричинені будь-кому за:
4. Всі інтелектуальні, майнові права Сайту належать ФОП Бондарчук В.В. Забороняється будь яке копіювання, скачування, сканування, парсінг Сайту. Втручання будь-яким чином у його роботу.

Політика конфіденційності сайту та файли cookie
1. Для створення бронювання Гостю необхідно створити власний аккаунт (кабінет) на Сайті. Створення такого кабінету вимагає від Гостя даних про себе. Приймаючи цю Оферту ви погоджуєтесь із збором та обробкою своїх даних Сайтом. Для видалення своїх даних з Сайту потрібно звернутися із відповідним запитом до Служби Підтримки Сайту.
2. Для коректного відображення змісту та для зручності використання сайту можуть застосовуватися файли cookies. У разі відмови від прийняття cookie-файлів, відповідальність за невірне відображення змісту лежить на Гостеві.
3. На сайті використовуються сторонні інтернет-сервіси, які здійснюють незалежний від Сайту збір інформації: Google Analytics, Google AdSense та інші. Ми не впливаємо на їхній збір даних, не відповідаємо за використання цими компаніями зібраних даних.
4. Сайт може оновлювати цей Договір будь якої миті і без попередження. Відповідальність за ознайомлення з останньою редакцією лежить на Гостеві. Якщо Гість не погоджується з цим Договором, то не може користуватися сайтом.
Заключні положення
1. На відносини Сторін, не врегульовані даним договором, поширюються норми діючого законодавства України.
2. Договір викладено українською мовою. Переклад на англійську несе суто інформаційний характер.
3. Інформація, зазначена на сторінках локацій, може бути неактуальною через військові дії в Україні.

PUBLIC OFFER AGREEMENT

This Agreement is public, in accordance with the Civil Code of Ukraine. By using this Site, you accept, join and agree to the terms of this agreement.

Terms and definitions
1. Guest - a person who uses the Site and/or makes a reservation in accordance with the conditions specified in this Agreement and is a party to this Agreement..
2. The Site (website) is an Internet resource located at https://yavdoma.com. The owner of the Site is FOP Bondarchuk Vitaliy Volodymyrovych, extract from the EDR, No. 2000680000000048838 dated 12/16/2020.
3. Reservation confirmation (hereinafter - Confirmation) - an electronic digital document/form containing information about the reservation.
4. Service provider - a person who posted information about the accommodation facility and provides accommodation services in this facility.
General Provisions
1. The site is an online platform where Service Providers post their accommodations, and Guests search for and book them.
2. FOP Bondarchuk V.V. is not a party to the agreement when making a reservation. FOP Bondarchuk V.V. owns the Site, and enables Guests to find and book accommodation provided by one of the Service Providers.
3. After the reservation, the Site will provide a Confirmation with detailed information about the reservation. The same Confirmation will be sent to the Supplier.
4. User support works according to the conditions set out in the relevant section on this site.
Prices and tariffs
1. The site does not take part in price formation, creation of tariff conditions, payment of accommodation services. The site is not responsible for the fulfillment of the tariff and payment conditions. The site is not responsible for possible damages that were caused as a result of non-fulfillment of the terms of tariffs and/or payments by either the Guest or the Supplier.
2. After booking, at the Supplier's request, the Guest must pay for the Supplier's services, including, if necessary, provide bank card details, including to guarantee a reservation. In case of full or partial non-payment, late payment, the Supplier has the right to cancel the reservation.
3. Obvious errors and typos, obviously non-market price for accommodation services, have no legal force. Such a reservation can be canceled with a refund to the Guest.
4. The site does not collect and transfer bank card data and does not participate in financial transactions (including deposit payments, insurance payments, cleaning payments, any other prepayment options). The Guest is responsible for providing or not providing bank card data.
5. Cancellation of the reservation can be made by the Guest, taking into account the conditions of the tariff. Cancellation by the Guest is possible only through the tourist's own account on the Site. Also, cancellation of the reservation can be carried out by the Supplier in case of non-arrival of the guest or refusal to fulfill the terms of the tariff or refusal to pay in full or in part. At the same time, all financial issues are resolved exclusively between the Guest and the Supplier. The site does not participate in financial transactions. The guest is responsible for possible damages caused as a result of the cancellation.
6. Cancellation of the reservation due to the Guest's "no-show" is carried out by the Supplier in accordance with the terms of the tariff specified in the reservation. The guest is responsible for possible damages caused as a result of non-arrival.
7. Changing the reservation involves changing the dates and the corresponding change in the cost of the reservation. Changing the reservation is possible only through the tourist's office on the Site. Changing the reservation is possible only if the Supplier has free rooms. In case of non-fulfillment of the tariff conditions when changing the reservation, the Supplier has the right to cancel such reservation. At the same time, the Supplier has the overriding right to demand advance payment of the reservation for the guarantee. Non-fulfillment of the payment conditions is grounds for cancellation of the reservation.

Site Rules and Disclaimers
1. Information on the Site about accommodation facilities posted by Suppliers using our platform. The supplier is responsible for the posted information about his object. If you find information that appears to you to be inappropriate, please notify us by email.
2. To create a reservation, the Guest must create his own account. The account stores information about all Guest reservations. The Guest can change or cancel the reservation only through his own tourist account. Communication between the Site and the Guest takes place mainly by e-mail, according to the schedule of the Site Support Service. At the same time, due to the workload, the Site Support Service does not guarantee timely service. Guest answers is responsible for maintaining access to your account, as well as for the correctness of providing an email address and phone number.

By accepting this Offer, you agree to the collection and processing of your data by the Site. To delete your data from the Site, you need to contact the Site Support Service with a corresponding request.
2. After providing personal data to Guests, the Site has the right to use this data in its marketing activities, for example: to send offers of discounts on hotel reservations.
3. Cookie files may be used for the correct display of content and for ease of use of the site. In case of refusal to accept cookies, responsibility for incorrect display of content lies with the Guest.
4. The site uses third-party Internet services that collect information independently of the Site: Google Analytics, Google AdSense, and others. We have no influence on their data collection, nor are we responsible for the use of the data collected by these companies.
5. The Site may update this Agreement at any time and without notice. The Guest is responsible for familiarizing himself with the latest edition. If the Guest does not agree with this Agreement, he cannot use the site.
Final provisions
1. The relations of the Parties, not regulated by this contract, are subject to the norms of the current legislation of Ukraine.
2. The contract is written in Ukrainian. The translation into English is purely informative.
3. The information on the location pages may be out of date due to military operations in Ukraine.
